A large number of cross-references to various bodies of text are used in legal texts, each serving a different purpose. It is often necessary for authorities and companies to look into certain types of these citations. Yet, there is a lack of automatic tools to aid in this process. Recently, citation graphs have been used to improve the intelligibility of complex rule frameworks. We propose an algorithm that builds the citation graph from a document and automatically labels each edge according (...) to its purpose. Our method uses the citing text only and thus works only on citations who’s purpose can be uniquely identified by their surrounding text. This framework is then applied to the US code. This paper includes defining and evaluating a standard gold set of labels that cover a vast majority of citation types which appear in the “US Code” but are still short enough for practical use. We also proposed a novel linear-chain conditional random field model that extracts the features required for labeling the citations from the surrounding text. We then analyzed the effectiveness of different clustering methods such as K-means and support vector machine to automatically label each citation with the corresponding label. Besides this, we talk about the practical difficulties of this task and give a comparison of human accuracy compared to our end-to-end algorithm. (shrink)

Reverend H.F.C. Logan is put forward as the formerly unidentified figure to which Robert Leslie Ellis referred in a journal entry of 1840 in which he wrote that it was due to his influence that William Whewell came to uphold particular Kantian views on time and space. The historical evidence of Ellis’s early familiarity with, and later commitment to Kant is noteworthy for at least two reasons. Firstly, it puts into doubt the accepted view of the second generation of (...) reformers of British algebra as non-philosophical, practice-oriented mathematicians. Secondly, in so far as Logan was the correspondent of William Rowan Hamilton, it re-emphasizes that the role of Kantianism in the transition from ‘symbolical’ to ‘abstract’ algebra in nineteenth-century British algebra requires closer scrutiny. This chapter attempts to look into a number of epistemological issues that are of significance to modern thought. The title of this chapter is adopted from Martin Buber's book wherein he drew attention to some of the key issues in what is referred to as the ‘new theology’ of Harry Williams, Pail Van Buren, and other such theologians, and also in William Hamilton and Thomas Altizer's ‘God is dead’ theology. As Buber asserts that the eclipse is something that (...) concerns our eyes and the sun, and not the sun itself, the eclipse of God that this chapter attempts to explain involves our own selfhood. The main problem faced by new theologians entails how they are not able to differentiate between God and their own subjectivity. This chapter looks into various controversies such as Gnosticism, Arianism, and other debates regarding the knowledge of God. (shrink)

Various laws and theories in the natural and social sciences are presented with a view to discerning the syntactic and semantic characteristics of many idealizations in science. Three different kinds of idealizations are discussed: ideal conditions, ideal cases, and idealized theories. An ideal condition is a formula in which state variables occur, whose existential closure is false, and for which there is another formula that can be constructed out of the original formula such that the existential closure of the new (...) formula is true. An ideal case is a statement which is logically equivalent to a universal conditional which has an ideal condition as its antecedent. And an idealized theory is a set of false universal conditional statements. Alternative syntactic and semantic analyses are viewed and criticized. (shrink)

ABSTRACTThis paper provides a detailed account of the period of the complex history of British algebra and geometry between the publication of George Peacock's Treatise on Algebra in 1830 and William Rowan Hamilton's paper on quaternions of 1843. During these years, Duncan Farquharson Gregory and William Walton published several contributions on ‘algebraical geometry’ and ‘geometrical algebra’ in the Cambridge Mathematical Journal. These contributions enabled them not only to generalize Peacock's symbolical algebra on the basis of geometrical considerations, (...) but also to initiate the attempts to question the status of Euclidean space as the arbiter of valid geometrical interpretations. At the same time, Gregory and Walton were bound by the limits of symbolical algebra that they themselves made explicit; their work was not and could not be the ‘abstract algebra’ and ‘abstract geometry’ of figures such as Hamilton and Cayley. The central argument of the paper is that an understanding of the contributions to ‘algebraical geometry’ and ‘geometrical algebra’ of the second generation of ‘scientific’ symbolical algebraists is essential for a satisfactory explanation of the radical transition from symbolical to abstract algebra that took place in British mathematics in the 1830s–1840s. William F. May, a leading expert on medical ethics, here explores two of today's most crucial tests of the traditional covenant between physicians and patients--active euthanasia and health care reform.

A brief discussion is offered of what it means to say that a set of statements provides D-N explanation with special emphasis given to approximative D-N explanation. An idealized theory is seen to provide approximative D-N explanation. An ideal case provides explanation only if postulates are offered which connect the ideal antecedent condition with actual conditions. Such postulates will help in accounting for deviations between what the consequent of the ideal case entails and what actually occurs. Three ways are presented (...) for deciding on the acceptability of idealizations: (i) as actual conditions more closely approximate the ideal antecedent conditions specified in an ideal case, the more closely actual cases ought to approximate the consequent of the ideal case; (ii) the additional postulates connecting ideal antecedent conditions with actual conditions ought to account for deviations between what is entailed by an idealized theory and what actually occurs; and (iii) an idealized theory is explained by a more general theory when certain state variables in the more general theory are given extreme values. It is argued that (iii) is not a necessary condition for the acceptability of idealizations. (shrink)

Conventional wisdom has it that evolution makes a sham of morality, even if morality is an adaptation. I disagree. I argue that our best current adaptationist theory of meaning offers objective truth conditionsfor signaling systems of all sorts. The objectivity is, however, relative to species – specifically to the adaptive history of the signaling system in question. While evolution may not provide the kind of species independent objective standards that (e.g.) Kantians desire, this should be enough for the practical work (...) of justifying our confidence in the objectivity of moral standards. The question concerning the meaning of life is important, but it immediately confronts the present authors with insurmountable obstacles from a philosophical standpoint, as it would require us to define not only what we hold to be life, but what we hold to be meaning in addition, requiring us to do both in a properly researched context. We unconditionally surrender to that challenge. Instead, we offer a vernacular, armchair approach to life’s origin and meaning, with some layman’s thoughts on the (...) meaning of origins as viewed from the biologist’s standpoint. One can observe that biologists generally approach the concept of biological meaning in the context of evolution. This is the basis for the broad resonance behind Dobzhansky’s appraisal that “Nothing in biology makes sense except in the light of evolution”. Biologists try to understand living things in the historical context of how they arose, without giving much thought to the definition of what life or living things are, which for a biologist is usually not an interesting question in the practical context of daily dealings with organisms. Do humans generally understand life’s meaning in the context of history? If we consider the problem of life’s origin, the question of what constitutes a living thing becomes somewhat more acute for the biologist, though not more answerable, because it is inescapable that there was a time when there were no organisms on Earth, followed by a time when there were, the latter time having persisted in continuity to the present. This raises the question of where, in that transition, chemicals on Earth became alive, requiring, in turn, a set of premises for how life arose in order to conceptualize the problem in relation to organisms we know today, including ourselves, which brings us to the point of this paper: In the same way that cultural narratives for origins always start with a setting, scientific narratives for origins also always start with a setting, a place on Earth or elsewhere where we can imagine what happened for the sake of structuring both the problem and the narrative for its solution. This raises the question of whether scientific origins settings convey meaning to humans in that they suggest to us from what kind of place and what kinds of chemicals we are descended, that is, to which inanimate things we are most closely related. Recent corporate legal and ethical meltdowns suggest that avoiding such harms to companies and to society requires a significant culture change within the organization. This paper addresses the issue of what it takes to change a corporate culture. While conventional wisdom may suggest that a change requires only the institution of an ethics office with proper reporting paths and an ethics code, such an approach is only a beginning. Many large corporations, especially those in danger of legal and ethical catastrophes, (...) need to undertake multiple initiatives to generate a new culture that manifests new values and new vocabularies. A cultural change accomplished by changing large numbers of personnel is expensive in financial and human terms. One component of a less costly approach is to tell new and different stories within the corporation because stories establish the cultural DNA that gives organizations, families, and individuals their identities. Such changes in individual firms, however, are influenced by the ideological assumptions within which and under which the industry and the society operates. (shrink)

In this paper we provide a psychological account of the nature and development of explanation. We propose that an explanation is an account that provides a conceptual framework for a phenomenon that leads to a feeling of understanding in the reader/hearer. The explanatory conceptual framework goes beyond the original phenomenon, integrates diverse aspects of the world, and shows how the original phenomenon follows from the framework. We propose that explanations in everyday life are judged on the criteria of empirical accuracy, (...) scope, consistency, simplicity, and plausibility. We conclude that explanations in science are evaluated by the same criteria, plus those of precision, formalisms, and fruitfulness. We discuss several types of explanation that are used in everyday life – causal/mechanical, functional, and intentional. We present evidence to show that young children produce explanations that have the same essential form as those used by adults. We also provide evidence that children use the same evaluation criteria as adults, but may not apply those additional criteria for the evaluation of explanations that are used by scientists. This paper was first presented as a plenary lecture to the Association for Education in Journalism and Mass Communication in August, 1985. The author, who is the Cary M. Maguire University Professor of Ethics at Southern Methodist University, discusses the intellectual, moral, and organizational marks of the professional that led reformers at the beginning of the twentieth century to locate professional training in the university. That discussion is followed by consideration of the moral consequences of university education for professionals, and (...) how journalists and all other professionals are, at base, teachers. We propose 4 equity-advancing operational improvements to eligibility and sign-up processes at mass vaccination sites: (1) preregistration using existing information, (2) eligibility rules that recognize the greater burden of COVID-19 in underserved neighborhoods, (3) appointment assignment that prioritizes those with disadvantage, and (4) socioculturally informed outreach to lottery selectees.

The realization that prokaryotes naturally and frequently disperse genes across steep taxonomic boundaries via lateral gene transfer gave wings to the idea that eukaryotes might do the same. Eukaryotes do acquire genes from mitochondria and plastids and they do transfer genes during the process of secondary endosymbiosis, the spread of plastids via eukaryotic algal endosymbionts. From those observations it, however, does not follow that eukaryotes transfer genes either in the same ways as prokaryotes do, or to a quantitatively similar degree. (...) An important illustration of the difference is that eukaryotes do not exhibit pangenomes, though prokaryotes do. Eukaryotes reveal no detectable cumulative effects of LGT, though prokaryotes do. A critical analysis suggests that something is deeply amiss with eukaryote LGT theories. In prokaryotes, genes from the environment can enter the genome via lateral gene transfer. In eukaryote genetics, natural variation comes from within the genome, not from the environment. Yet many reports claim that eukaryotes undergo LGT just like prokaryotes. Such claims do not withstand scrutiny and are probably untrue. (shrink)

Extracorporeal membrane oxygenation (ECMO) is a form of life support for cardiac and/or pulmonary failure with unique ethical challenges compared to other forms of life support. Ethical challenges with ECMO exist when conventional standards of care apply, and are exacerbated during periods of absolute ECMO scarcity when “crisis standards of care” are instituted. When conventional standards of care apply, we propose that it is ethically permissible to withhold placing patients on ECMO for reasons of technical futility or when patients have (...) terminal, short-term prognoses that are untreatable by ECMO. Under crisis standards of care, it is ethically permissible to broaden exclusionary criteria to also withhold ECMO from patients who have a low likelihood of recovery, to maximize the overall number of lives saved. Unilateral withdrawal of ECMO against a patient’s preferences is unethical under conventional standards of care, but is ethical under crisis standards of care to increase access to ECMO to others in society. ECMO should only be rationed when true scarcity exists, and allocation protocols should be transparent to the public. When rationing must occur under crisis standards of care, it is imperative that oversight bodies assess for inequities in the allocation of ECMO and make frequent changes to improve any inequities. Information theory offers a measure of "mutual information" which provides an appropriate measure of tracking efficiency for the naturalistic epistemologist. The statistical entropy on which it is based is arguably the best way of characterizing the uncertainty associated with the behavior of a system, and it is ontologically neutral. Though not appropriate for the naturalization of meaning, mutual information can serve as a measure of epistemic success independent of semantic maps and payoff structures. While not containing payoffs as terms, mutual (...) information places both upper and lower bounds on payoffs. This constitutes a non-trivial relationship to utility. (shrink)

The characteristic claim of Christianity, as codified at Chalcedon, is that God the Son, the second person of the Trinity, is numerically the same person as Jesus of Nazareth. This article raises three questions that appear to threaten the coherence of orthodox Chalcedonian incarnationalism. First, how can one person exemplify seemingly incompatible natures? Second, how can one person exemplify seemingly incompatible non-nature properties? Third, how can there be one person if the concept of incarnation implies that one person incarnates himself (...) as another person? The attempts of C. S. Lewis and T. V. Morris to deal with these difficulties are examined and found inconclusive. (shrink)
